CLUB HOUSE RULES & REGULATIONS |
1. Clubhouse Users:
- Must be Community Association of Five Canyons owner-of-record at least 21 years of age.
- Private parties only. There shall be no private business use, including private functions to which a fee is charged to the guests. There shall be no private charitable/fundraising events.
- Centex-Five Canyons community groups comprised wholly of Association members and their families may use the clubhouse at a reduced rate for Monday through Thursday events that are not Association sponsored. Such usage is subject to availability and cannot be booked more than 60 days in advance. An application from the group must be on file with, and giver approval, by the Association.
- Association sponsored activities always take precedence over private functions or community
group events.
2. Rental Requests:
- Accepted on a first-come, first-served basis.
- The Clubhouse is available only by reservation by calling Five Canyons
Recreation Center Office or Walsh Property Management at (510)888-8965.
- An "Agreement for Use of Clubhouse" must be filed within at least 14 days of
reservation accompanied by the non-refundable rental fee for private parties.
- Rentals may not be made more than 180 days in advance, with the exception of weddings and/or wedding receptions, which can be made 9 months in advance.
Owners who have rented the Clubhouse during the previous twelve months can reserve the facility no earlier than 45 days in advance and no later than 14 days in advance.
- Owners who are delinquent in the payment of their monthly homeowners assessment or
have an outstanding infraction (determined after notice and hearing has been held) of the
Association's Declaration of Covenants, Conditions and Restrictions of Association Rules will not be allowed to reserve the Clubhouse.
3. Insurance:
- A waiver of liability will be required. The member must obtain a certificate of insurance from his/her homeowner's insurance carrier naming the Association as an additional insured during the rental period for a minimum level of $300,000.00.
- Evidence of such insurance shall accompany owner's "Agreement for Use of the Clubhouse".
4. Rental Area:
- Reservation of the Clubhouse is limited to the interior of the Clubhouse (great room, kitchen and bathrooms), and enclosed patio area only. At no time shall a private function encroach upon other recreational areas of the community (i.e., pool/spa/wading/deck areas, tennis and basketball courts, picnic areas, etc.). All private gatherings must be contained within the Clubhouse.
5. Responsibilities:
- Owner is responsible for leaving the Clubhouse in the same clean condition in which it was found.
- There is no rental fee for the tables and chairs but there is no discount given if owner decides to bring in outside rentals. Member is responsible for setting up, taking down and putting away tables and chairs. Care must be taken with cart, chairs and tables.
- Owner must sign an "Agreement for Use of Clubhouse" and submit it with the check for the non-refundable rental fee. Evidence of insurance for the function must be submitted with the
damage deposit no later than 14 days prior to the function.
- If Owner's checks are not honored, the fees will be added to Owner's monthly dues, and
after hearing and notice, use of the Clubhouse may be denied for twelve (12) months. Owner must be available to fill out the "Pre- and Post-Function Checklist" at which time the
clubhouse key will be picked up and returned. Owner must remain with guests at all times.
- All lights and appliances (except refrigerator) must be turned off after use.
Members serving alcoholic beverages do so without the consent of the Association and are solely responsible and liable for all actions arising from this activity.
- There are no trash disposal facilities at the Clubhouse. Trash must be removed from the
Clubhouse at conclusion of event.
- An adult must accompany children at all times.
6. Hours:
- The Clubhouse hours are 8:00 a.m. to 11:00 p.m. Sunday through Thursday; and 8:00 a.m. to 12:00 a.m. on Friday and Saturday. Note that these hours include clean-up time.
- No parties will be allowed to begin after 8:00 p.m. Premise must be vacated by 11:00 p.m.
Sunday through Thursday, or 12:00 a.m. Friday or Saturday. NO EXCEPTIONSIII Maximum rental period will be for six hours, which includes
clean-up time.
- Should private functions extend beyond six hours (within above Clubhouse hours), there will be a $25.00 per hour (or increment thereof) additional rental charge (which will be deducted
from the member's deposit).
7. Not Allowed:
- No pets or wet bathing suits are allowed in the Clubhouse at any time.
- Undue noise is not allowed. There is a local noise ordinance in Alameda County; surrounding residents may call the police if you are disturbing the peace. Sale of any item, including liquor, is prohibited.
- There shall be no private business use, including private functions for which a fee is charged to the guests. There shall be no private charitable/fundraising events.
- smoking is prohibited in the Clubhouse. The area outside the Clubhouse front entrance is the
only designated smoking area (ashtrays must be used).
- Red wine and red fruit punch are strongly discouraged as such spills often result in
irremovable carpet stains. Members are advised that irremovable stains will result in the
assessment of carpet replacement.
- Encroachment upon and use of other recreation facilities is prohibited.
- Decorations may be applied, but only if they do not puncture or otherwise damage the facilities. Tacks, staples, nails, tape etc. cannot be used.
8. General:
- Owner is personally liable for any damages to the facility and its contents during the private function. The Association will assess the amount of damage, if any, and the charge will be added to the Owner's assessment account.
- The clubhouse key is available for pick-up only when performing the "Pre Function Checklist'. The key must be returned during the "Post Function Checklist". The Inspector's report will be used in determining refund of deposit.

- The fee to use the facility Is $375 for up to 6 hours and $25 for additional hours
Clubhouse maximum capacity is 154 seated, 299 standing. NO EXCEPTIONS!!!
